Điều khoản dịch vụ

Điều khoản dịch vụ này (“Điều khoản”) điều chỉnh việc bạn truy cập và sử dụng website, ứng dụng và các dịch vụ liên quan của 1System (“Dịch vụ”), được vận hành bởi CÔNG TY CỔ PHẦN CÔNG NGHỆ VÀ DỊCH VỤ WINX. Vui lòng đọc kỹ. Bằng việc tạo tài khoản hoặc sử dụng Dịch vụ, bạn đồng ý bị ràng buộc bởi các Điều khoản này. Nếu không đồng ý, vui lòng không sử dụng Dịch vụ.
1. Chấp nhận Điều khoản
Bằng việc truy cập hoặc sử dụng Dịch vụ, bạn xác nhận đã đọc, hiểu và đồng ý với các Điều khoản này cùng Chính sách quyền riêng tư. Nếu sử dụng thay mặt một tổ chức, bạn cam kết được ủy quyền để chấp nhận các Điều khoản này.
2. Về Dịch vụ
1System cung cấp công cụ giúp doanh nghiệp giao tiếp và quản lý khách hàng của chính họ. Chúng tôi có thể bổ sung, thay đổi hoặc gỡ bỏ tính năng theo thời gian để cải thiện Dịch vụ.
3. Điều kiện và Đăng ký
Để sử dụng Dịch vụ, bạn phải đủ 16 tuổi trở lên và có khả năng giao kết hợp đồng ràng buộc. Khi tạo tài khoản, bạn đồng ý cung cấp thông tin chính xác, đầy đủ và cập nhật khi cần.
4. Tài khoản và trách nhiệm của bạn
Bạn chịu trách nhiệm giữ bí mật thông tin đăng nhập và mọi hoạt động dưới tài khoản của mình; vui lòng thông báo ngay nếu có việc sử dụng trái phép. Bạn chịu trách nhiệm về nội dung, dữ liệu mình cung cấp và bảo đảm có đủ quyền để sử dụng chúng với Dịch vụ.
5. Sử dụng hợp lệ
Bạn đồng ý sử dụng Dịch vụ hợp pháp và có trách nhiệm. Cụ thể, bạn không được:
- Sử dụng Dịch vụ cho mục đích trái pháp luật, gây hại hoặc gian lận;
- Gửi tin rác hoặc xâm phạm quyền, quyền riêng tư của người khác;
- Làm gián đoạn, phá hoại hoặc truy cập trái phép Dịch vụ hoặc hệ thống liên quan;
- Sao chép, bán lại hoặc lạm dụng Dịch vụ ngoài phạm vi được phép;
- Lưu trữ hoặc truyền tải nội dung bất hợp pháp, phản cảm hoặc xâm phạm quyền của người khác.
6. Gói dịch vụ và Thanh toán
Một số tính năng có thu phí. Khi đăng ký gói trả phí, bạn đồng ý thanh toán các khoản phí áp dụng. Trừ khi có quy định khác hoặc pháp luật yêu cầu, phí được thu trước và không hoàn lại. Chúng tôi có thể thay đổi bảng giá và sẽ thông báo hợp lý về các thay đổi ảnh hưởng đến bạn.
7. Nội dung và dữ liệu của bạn
Bạn giữ quyền sở hữu đối với nội dung và dữ liệu mình cung cấp, và cấp cho chúng tôi các quyền giới hạn cần thiết để vận hành và cung cấp Dịch vụ. Cách chúng tôi xử lý thông tin cá nhân được mô tả trong Chính sách quyền riêng tư.
8. Sở hữu trí tuệ
Dịch vụ, bao gồm thiết kế, phần mềm và nội dung do chúng tôi cung cấp, thuộc sở hữu của 1System hoặc bên cấp phép và được pháp luật bảo hộ. Các Điều khoản này không trao cho bạn quyền sở hữu Dịch vụ. Bạn không được sao chép, chỉnh sửa hoặc tạo tác phẩm phái sinh, trừ khi được phép rõ ràng.
9. Dịch vụ bên thứ ba
Dịch vụ có thể cho phép bạn kết nối hoặc tương tác với dịch vụ do bên khác cung cấp. Việc sử dụng các dịch vụ đó tuân theo điều khoản riêng của họ và chúng tôi không chịu trách nhiệm về chúng.
1System sử dụng Dịch vụ API của YouTube. Nếu kết nối kênh YouTube, bạn đồng ý tuân theo Điều khoản dịch vụ của YouTube; việc Google sử dụng dữ liệu của bạn tuân theo Chính sách quyền riêng tư của Google. Cách 1System xử lý dữ liệu YouTube được nêu trong Chính sách quyền riêng tư của chúng tôi.
10. Tính sẵn sàng và Thay đổi
Chúng tôi nỗ lực giữ Dịch vụ sẵn sàng và ổn định, nhưng không bảo đảm hoạt động liên tục hoặc không lỗi. Chúng tôi có thể thay đổi, tạm ngừng hoặc chấm dứt toàn bộ hoặc một phần Dịch vụ vào bất kỳ lúc nào, và sẽ cố gắng thông báo hợp lý khi phù hợp.
11. Tạm ngừng và Chấm dứt
Bạn có thể ngừng sử dụng Dịch vụ bất cứ lúc nào. Chúng tôi có thể tạm ngừng hoặc chấm dứt quyền truy cập nếu bạn vi phạm các Điều khoản này, hoặc khi cần bảo vệ Dịch vụ hoặc người dùng khác. Khi chấm dứt, quyền sử dụng của bạn kết thúc, nhưng một số điều khoản vẫn tiếp tục có hiệu lực.
12. Tuyên bố miễn trừ
Dịch vụ được cung cấp theo hiện trạng (“as is”) và theo mức độ sẵn có (“as available”), không kèm bảo đảm nào, dù rõ ràng hay ngụ ý, trong phạm vi pháp luật cho phép. Chúng tôi không bảo đảm Dịch vụ đáp ứng mọi yêu cầu của bạn hoặc tạo ra kết quả cụ thể.
13. Giới hạn trách nhiệm
Trong phạm vi pháp luật cho phép, 1System sẽ không chịu trách nhiệm đối với bất kỳ thiệt hại gián tiếp, ngẫu nhiên hoặc hệ quả nào, hoặc tổn thất về lợi nhuận, dữ liệu hay uy tín phát sinh từ việc bạn sử dụng Dịch vụ.
14. Luật áp dụng
Các Điều khoản này được điều chỉnh bởi pháp luật Việt Nam. Mọi tranh chấp liên quan sẽ được giải quyết bởi cơ quan có thẩm quyền tại Việt Nam, trừ khi pháp luật quy định khác.
15. Thay đổi Điều khoản
Chúng tôi có thể cập nhật các Điều khoản này theo thời gian. Khi có thay đổi đáng kể, chúng tôi sẽ đăng phiên bản cập nhật trên trang này và cập nhật ngày hiệu lực. Việc bạn tiếp tục sử dụng Dịch vụ sau đó đồng nghĩa với việc chấp nhận các Điều khoản đã sửa đổi.

These Terms of Service (“Terms”) govern your access to and use of the 1System website, applications, and related services (the “Services”), operated by WINX Technology and Service Joint Stock Company. Please read these Terms carefully. By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Acceptance of Terms
By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. The Service
1System provides tools that help businesses communicate with and manage their own customers. We may add, change, or remove features from time to time to improve the Services.
3. Eligibility and Registration
To use the Services, you must be at least 16 years old and able to enter into a binding agreement. When you create an account, you agree to provide accurate and complete information and to keep it up to date.
4. Your Account and Responsibilities
You are responsible for keeping your account credentials confidential and for all activity under your account; please notify us promptly of any unauthorized use. You are responsible for the content and data you submit and for ensuring you have the rights needed to use it with the Services.
5. Acceptable Use
You agree to use the Services lawfully and responsibly. In particular, you must not:
- Use the Services for any unlawful, harmful, or fraudulent purpose;
- Send spam or violate the rights or privacy of others;
- Disrupt, damage, or gain unauthorized access to the Services or related systems;
- Copy, resell, or misuse the Services beyond what is permitted;
- Store or transmit content that is illegal, offensive, or infringes the rights of others.
6. Subscriptions and Payment
Some features are offered on a paid basis. When you subscribe, you agree to pay the applicable fees. Unless stated otherwise or required by law, fees are charged in advance and are non-refundable. We may change our pricing and will give reasonable notice of changes that affect you.
7. Your Content and Data
You retain ownership of the content and data you provide, and grant us the limited rights necessary to operate and provide the Services. How we handle personal information is described in our Privacy Policy.
8. Intellectual Property
The Services, including their design, software, and the content we provide, are owned by 1System or its licensors and are protected by law. These Terms do not grant you ownership of the Services. You may not copy, modify, or create derivative works except as expressly permitted.
9. Third-Party Services
The Services may let you connect or interact with services provided by others. Your use of those services is subject to their own terms, and we are not responsible for them.
1System uses YouTube API Services. If you connect a YouTube channel, you agree to be bound by the YouTube Terms of Service, and Google’s use of your data is governed by the Google Privacy Policy. How 1System handles YouTube data is described in our Privacy Policy.
10. Availability and Changes
We work to keep the Services available and reliable, but do not guarantee they will be uninterrupted or error-free. We may modify, suspend, or discontinue all or part of the Services at any time, and will try to give reasonable notice where appropriate.
11. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms, or if necessary to protect the Services or other users. Upon termination, your right to use the Services ends, though certain provisions continue to apply.
12. Disclaimers
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Services will meet all your requirements or produce any specific results.
13. Limitation of Liability
To the fullest extent permitted by law, 1System will not be liable for any indirect, incidental, or consequential damages, or for any loss of profits, data, or goodwill arising from your use of the Services.
14. Governing Law
These Terms are governed by the laws of Vietnam. Any dispute relating to these Terms or the Services will be handled by the competent authorities in Vietnam, unless otherwise required by applicable law.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the effective date. Your continued use of the Services after the changes take effect means you accept the revised Terms.
